La telenovela es un género dramático y visual, de gran popularidad en países de habla hispana y con una audiencia en amplio crecimiento en otros como Estados Unidos. A pesar del enorme mercado televisivo, y del reconocimiento mediático de sus actores, las producciones de telenovela han sido objeto de una crítica condescendiente y paternalista por muchos académicos, quienes las restringen o bien a ser meros instrumentos para adoctrinar a la sociedad a escapar de sus problemas y conformarse con sus circunstancias (...) vitales, o a ser acompañamientos del ocio femenino y diversión de la clase más popular y trabajadora. No obstante, críticos menos reduccionistas como Trejo Silva, Martínez Zarandona, Guerra, Martín Barbero o Tufte han señalado el efecto transformador y educativo de su temática más reciente, centrándose especialmente en el cambio producido en la evolución de los personajes y las situaciones. "Por ella soy Eva" (mejor telenovela de 2013 por los premios TVyNovela de México), ilustra nuevas situaciones de género menos asfixiantes para la mujer y aborda, con clara intención crítica, el machismo existente en la sociedad mexicana. A través del concepto de entretenimiento educativo, esta telenovela augura un futuro revitalizador para un género que para muchos se había estancado como trasunto del folletín decimonónico. (shrink)

While rooted in careful study of Mead’s original writings and transcribed lectures and the historical context in which that work was carried out, the papers in this volume have brought Mead’s work to bear on contemporary issues in metaphysics, epistemology, cognitive science, and social and political philosophy.

This article treats recent bioethical discussions of double effect reasoning (DER), offering a summary account of DER and construing it as rooted in a sensible view of what is central to someone's identity as a moral agent. It then treats objections raised in recent years by Judith Thomson, Alison McIntyre, and Frances Kamm against familiar ways of applying DER to certain controversies within medical ethics, especially, that over physician-assisted suicide. After detailing, interpreting, and attempting to rebut the challenges from (...) these philosophers, who are especially interesting because their criticisms of DER come from allies in DER's struggle against consequentialist reasoning, the essay engages DER's contribution to a recent dispute over treatment of patients in what is called ‘persistent vegetative state.' Near its end, the paper sketches several possible points of entry to DER and sources of justification for it. The essay concludes by indicating a connection between these paths and its opening idea of moral identity. (shrink)

In this paper we propose an ‘undisciplinary’ meeting between Elinor Ostrom and Judith Butler, with the intent to broaden the theory of the commons by discussing it as a relational politics. We use Butler’s theory of power to problematize existing visions of commons, shifting from Ostrom’s ‘bounded rationality’ to Butler’s concepts of ‘bounded selves’ and mutual vulnerability. To be bounded – as opposed to autonomous being – implies being an (ambiguous) effect of socio-power relations and norms that are often (...) beyond control. Thus, to be a collective of bounded selves implies being mutually vulnerable in power relations which are enabling, albeit injurious. A politics of commoning is not a mere technical management of resources (in space) but a struggle to perform common livable relations (in time). We argue that the multiple exposures which produce us are also the conditions of possibility for more just and equalitarian ‘re-commoning’ of democracies around the world. (shrink)

In this paper we explore the possibilities of a sexual ethics that responds to our times of precariousness. We sustain that the task of a reconsidered sexual ethics can contribute to a more livable life for persons rendered fragile beyond our constitutive embodied fragility. Thus, we connect Judith Butler with 20th century dialogical philosophies as well as with some analysis on sexuality and ethics in authors like Thomas Nagel and Margaret Farley. La permisividad en el discurso público a ideas y prejuicios contrarios a la inmigración es consustancial al formato necropolítico de gestión de las migraciones en la Unión Europea. Este trabajo, inspirado en las aportaciones de Achille Mbembe y Judith Butler, reflexiona sobre la configuración del sentimiento antinmigrante que, articulado a través de la violencia simbólica que atraviesa medios (...) de comunicación y redes sociales, repercute en la creciente vulnerabilidad que afecta a este colectivo. Since the publication of Hartry Field’s influential paper “Tarski’s Theory of Truth” there has been an ongoing discussion about the philosophical import of Tarski’s definition. Most of the arguments have aimed to play down that import, starting with that of Field himself. He interpreted Tarski as trying to provide a physicalistic reduction of semantic concepts like truth, and concluded that Tarski had partially failed. Robert Stalnaker and Scott Soames claimed then that Field should have obtained a stronger conclusion, namely that (...) Tarski’s failure in his allegedly intended physicalistic reduction was total. From another front, Hilary Putnam argued for an even more sweeping thesis: “[a]s a philosophical account of truth, Tarski’s theory fails as badly as it is possible for an account to fail.” Scott Soames followed suit also on this count, endorsing Putnam’s argument in section iii of the aforementioned paper; and John Etchemendy used a very similar argument to contend that “a Tarskian definition of truth [...] cannot possibly illuminate the semantic properties of the object language.” The paper argues that these contentions are based on several misunderstandings about the nature of a definition like Tarski’s. Regarding the Putnam-Soames-Etchemendy argument, we must apply a distinction Frege found natural to draw—and is natural to draw anyway—between what he called “constructive” definitions, definitions properly so called, which are mere stipulations, and what he described as “analytic” definitions, definitions which aim to make explicit the meaning of a term already in use. Regarding the Field-Soames-Stalnaker criticism, the paper contends that the true aims of a Tarskian truth definition are perfectly well fulfilled without Field’s amendments. (shrink)

The claim that knowledge is grounded on a basic, non-inferentially grasped set of principles, which seems to be Aristotle’s view, in contemporary epistemology can be seen as part of a wider foundationalist account. Foundationalists assume that there must be some premise-beliefs at the basis of every felicitous reasoning which cannot be themselves in need of justification and may not be challenged. They provide justification for truths based on these premises, which Aristotle unusually call principles (archái). Can Aristotle be considered a (...) foundationalist? Are his first principles necessary premises to right inferences? We will look at the issue here. (shrink)

Online Public Shaming is a form of norm enforcement that involves collectively imposing reputational costs on a person for having a certain kind of moral character. OPS actions aim to disqualify her from public discussion and certain normal human relations. We argue that this constitutes an informal collective punishment that it is presumptively wrong to impose on others. OPS functions as a form of ostracism that fails to show equal basic respect to its targets. Additionally, in seeking to mobilise unconstrained (...) collective power with potentially serious punitive consequences, OPS is incompatible with due process values. (shrink)

Almost all admit that there is beauty in the natural world. Many suspect that such beauty is more than an adornment of nature. Few in our contemporary world suggest that this beauty is an empirical principle of the natural world itself and instead relegate beauty to the eye and mind of the beholder. Guided by theological and scientific insight, the authors propose that such exclusion is no longer tenable, at least in the data of modern biology and in our view (...) of the natural world in general. More important, we believe an empirical aesthetics exists that can help guide experimental design and development of computational models in biology. Moreover, because theology and science can both contribute toward and equally profit from such an aesthetics, we propose that this empirical aesthetics provides the foundation for a living synergy between theology and science. The organism-in-its-environment is recognized as the basic unit of analysis when dealing with living beings. This paper seeks to define the fundamental implications of the concept of the organism-in-its-environment in terms of the biosemiotic concept of human distributed cognition. Human distributed cognition in a biosemiotic context is defined as the ability of a self-referencing organism-in-its-environment to interact with its environment to satisfy its physiological and social needs to survive and sustain itself. The ontogenetic development of the organism-in-its-environment serves as the (...) backdrop to discover the implications of distributed cognition that have general applicability in organisms, but in this paper, are made relevant to human beings. Background: Nurses who practice limitation of therapeutic effort become fully involved in emotionally charged situations, which can affect them significantly on an emotional and professional level. Objectives: To describe the experience of intensive care nurses practicing limitation of therapeutic effort. Method: A qualitative, phenomenological study was performed within the intensive care units of the Madrid Hospitals Health Service. Purposeful and snowball sampling methods were used, and data collection methods included semi-structured and unstructured interviews, researcher field notes, and participants’ personal letters. (...) The Giorgi proposal for data analysis was used on the data. Ethical considerations: This study was approved by the Ethical Research Committee of the relevant hospital and by the Ethics Committee of the Rey Juan Carlos University and was guided by the ethical principles of voluntary enrollment, anonymity, privacy, and confidentiality. Results: In total, 22 nurses participated and 3 themes were identified regarding the nurses’ experiences when faced with limitation of therapeutic effort: (a) experiencing relief, (b) accepting the medical decision, and (c) implementing limitation of therapeutic effort. Conclusion: Nurses felt that, although they were burdened with the responsibility of implementing limitation of therapeutic effort, they were being left out of the final decision-making process regarding the same. Wittgenstein distinguished between two uses of “I”, one “as object” and the other “as subject”, a distinction that Shoemaker elucidated in terms of a notion of immunity to error through misidentification (“IEM”); first-personal claims are IEM in the use “as subject”, but not in the other use. Shoemaker argued that memory judgments based on “personal”, episodic memory are not strictly speaking IEM; Gareth Evans disputed this. Similar issues have been debated regarding self-ascriptions of conscious thoughts based on first-personal awareness, in (...) the light of claims of “thought insertion” in schizophrenic patients. The paper aims to defend a Shoemaker-like line by critically engaging with some compelling recent contributions. Methodologically, the paper argues that to properly address these issues the all-inclusive term “thought” should be avoided, and specific types of thoughts countenanced. (shrink)

In a recent paper, Peacocke (2001) continues an ongoing debate with McDowell and others, providing renewed arguments for the view that perceptual experiences and some other mental states have a particular kind of content, nonconceptual content. In this article I want to object to one of the arguments he provides. This is not because I side with McDowell in the ongoing debate about nonconceptual content; on the contrary, given the way I understand it, my views are closer to Peacocke’s, and (...) have been strongly influenced by him. Dans le contexte de pratiques de simulation transversales, Croce semble entrevoir une esthétique qui réhabilite l’individualité et l’intériorité du créateur dans une perspective contemporaine.

Two ideas shape the epistemology of testimony. One is that testimony provides a unique kind of knowledge. The other is that testimonial knowledge is a social achievement. In traditional terms, those who affirm these ideas are anti-reductionists, and those who deny them are reductionists. There is increasing interest, however, in the possibility of affirming these ideas without embracing anti-reductionism. Thus, Sanford Goldberg uses the idea of epistemic buck-passing to argue that even reductionists can accept the uniqueness of testimonial knowledge, and (...) Jennifer Lackey gives both speaker and hearer an essential role in testimonial justification, rejecting both reductionism and anti-reductionism in favor of what she calls dualism. After distinguishing a weaker and a stronger notion of buck-passing, we show how anti-reductionists can use the stronger notion to motivate their position, and to answer Goldberg’s and Lackey’s challenges. The Thesis of Theory-Laden [TTL] holds that is not possible a neutral observation. From this thesis, some philosophers have inferred that the facts, i.e., the subject’s independent reality, do not exist or that they are social constructions only. The aim of this paper is assess if TTL necessarily implies a constructivist point of view or if, conversely, we can still speak about the reality. In order to do this, we will clarify these terms: "the theory-ladenness of observation" and "constructivism". Then, (...) we will argue that although TTL is possible, we are not committed to constructivism, and on the contrary, TTL can be an interesting frame to the realistic thesis. Finally, we will point out the impact this had has when evaluating many epistemological proposals. La tesis de la carga teórica de la observación [CTO] sostiene que no es posible una observación neutral. A partir de esta tesis, algunos filósofos han derivado que los hechos, o mejor, la realidad independiente del sujeto, no existen o que son solo construcciones sociales. El objetivo de este artículo es evaluar si CTO implica necesariamente una visión constructivista o si, por el contrario, permite seguir hablando de realidad. Para ello, se aclararán los conceptos de "carga teórica de la observación" y de "constructivismo". Posteriormente, se defenderá que pese a la plausibilidad de CTO, no estamos comprometidos a adoptar el constructivismo, antes bien, CTO puede ser un interesante marco para las tesis realistas. Finalmente, se señalarán algunas repercusiones que esto tiene a la hora de evaluar propuestas epistemológicas. (shrink)

International Human Rights Law is clear in holding only states or state-like entities responsible for human rights abuses, yet activists and philosophers alike do not see any rational basis for this restriction in responsibility. Multi-national corporations, individuals and a whole array of other 'non‐state actors' are capable of harming vital human interests just as much as states, so why single-out the latter as human rights-responsible agents? In this paper I distinguish two ways of looking at human rights responsibility. One is (...) simply in terms of the outcomes that are deemed desirable to avoid (or secure), and the other is in terms of the relationships one sees these moral standards as governing. I argue that the peculiar form of responsibility and responsiveness (the way of 'holding to account')inherent to human rights principles is directed at establishing a particular type of relationship: one in which individuals are empowered in the face of a very special form of communal power. Other kinds of relationship and potential transgression are more appropriately governed by different kinds of moral principles, such as those relating to criminality. The outcomes view fails to incorporate this insight and for that reason fails to see the distinct role played by human rights standards in our moral reasoning: they are precisely valuable because they provide a way to judge the relationship of individuals to the peculiar kind of power exercised by the state. Part of this project is a re-assessment of the methodology employed by philosophers in establishing moral principles and concepts, such as those relating to human rights standards. (shrink)

In a recent contribution to legal ontology, Kenneth Ehrenberg identifies a puzzle concerning _the basic validity rule_ of legal systems: If formal institutions require a codified foundational constitutive rule, then legal systems cannot be formal institutions, since their foundational constitutive rule is necessarily an uncodified basic validity rule. To solve this puzzle, Ehrenberg suggests taking this rule as ‘a foundational and self-identifying institutional fact’. Here, I challenge his solution and the very existence of this puzzle. By arguing, contra Ehrenberg, that (...) the basic validity rule is not the foundational constitutive rule of a legal system, but only the foundational constitutive rule of legal validity; that its codification in fact contributes towards the institutionalisation of a legal system; and that the true foundational constitutive rule of a legal system is the formal group structure of the higher-constitutional organisations, I submit an alternative account of the institutional nature of legal systems. Esse artigo pretende discutir, em um primeiro momento, o sentido, para a psicologia de Nietzsche, da figura de Jesus n’_O Anticristo_. Mais precisamente, esse artigo parte de uma problematização dessa tipologia de Jesus, para, em seguida, fazer convergir essa estratégia psicológica com uma semiótica, isto é, uma análise do uso dos signos pelo tipo Jesus. Depois de contextualizar a discussão sobre o tipo Jesus como “simbolista” e “antirrealista”, mostramos como Nietzsche, estrategicamente, elabora em suas últimas obras uma efetiva confrontação simbólica (...) entre o tipo Jesus e Dioniso, e a partir disso buscamos indicar algumas conclusões. A questão do relacionamento entre a normatividade e valoração e sua incorporação no discurso racional é um dos problemas mais relevantes na filosofia contemporânea e é claramente desdobrada em todas as suas complexidades no debate paradigmático mantido entre Hilary Putnam e Jürgen Habermas durante a primeira década do século XXI. A partir dessas posições que reivindicam a tradição do pragmatismo americano, os filósofos discutem a objetividade dos juízos de valor e normativos defendendo, com diferenças significativas, uma posição cognitivista. A presente (...) contribuição aborda essa discussão com o propósito de apresentar o pragmatismo conceitualista de Clarence Irving Lewis como uma alternativa e posição profícua com os recursos para interagir com algumas das principais questões discutidas por Putnam e Habermas. Meu propósito é mostrar o modo como Lewis explica o caráter cognitivo das normas e valores enquanto sustenta, simultaneamente, uma demarcação significativa entre ambos os conceitos. Argumentarei que essa distinção é pragmática – não epistêmica –, e que isso permite ao pragmatista defender um cognitivismo que pode articular um naturalismo não reducionista referente aos valores com um conceito racionalista de normas, uma posição que pode evitar algumas das objeções que enfrentam Putnam e Habermas. Final value accrues to objects that are good for their own sakes, while instrumental value accrues to objects that are good for the sake of their effects. The following paper aims to show that this distinction cuts across some surprising areas of the evaluative domain. This means that there may be some unexpected types of value that can come in a final or instrumental form. The argument proceeds by looking at two prominent types of value, namely kind-value and personal value. (...) The former accrues to objects that are good as the kinds of things that they are, while the latter accrues to objects that are good for someone. Substantive examples are offered in support of the idea that these types of value can come in final or instrumental form. Richard Moran has argued, convincingly, in favour of the idea that there must be more than one path to access our own mental contents. The existence of those routes, one first-personal—through avowal—the other third-personal—no different to the one used to ascribe mental states to other people and to interpret their actions—is intimately connected to our capacity to respond to norms. Moran’s account allows for conflicts between first personal and third personal authorities over my own beliefs; this enable some instances of (...) Moore-paradoxical cases to be meaningful. In this paper we reflect on the consequences of this view for the acquisition of beliefs, and argue that, as in the moral case, excessive concentration on a thirdpersonal understanding of thought undermines the very idea of being directed to the world and of being capable to fully own our own beliefs. We suggest that maybe too much attention to epistemic virtues or tojustification is misdirected and could produce beliefs that are themself not first-personal enough. (shrink)

Although there is already an important discussion regarding social ontology (a first-order investigation about social entities, e.g., social objects, social events, social relations, and social categories), not much attention has been paid to social meta-ontology (a second-order inquiry concerning what it means and how to answer whether there are any such entities). With the intention to contribute towards bringing the latter into the philosophical spotlight, I submit here a brief survey of the meta-ontological issues about two specific kinds of social (...) entities, viz., social and institutional practices. After elaborating on Thomasson’s easy approach to ontology, I argue that it can be extended to account for the existence of those social entities. (shrink)

This paper delves into the character concept as applied to reproduction. Our argument is that the prevailing functional-adaptationist perspective falls short in explaining the evolution of reproductive traits, and we propose an alternative organismal-relational approach that incorporates the developmental and interactive aspects of reproduction. To begin, we define the functional individuation of reproductive traits as evolutionary strategies aimed at enhancing fitness, and we demonstrate how this perspective influences the classification of reproductive characters and modes, the comprehension of shared traits as (...) resulting from conflicts of evolutionary interest between individuals, and the explanation of reproductive diversity. After outlining the shortcomings of this framework, we introduce an organismal-relational approach grounded in evolutionary developmental studies of reproduction. This view provides a revised classification for reproductive characters and modes and offers a new understanding of interorganismal traits that takes into account their inherently relational nature. Lastly, we present the research agenda that emerges from this approach, which addresses the core explanatory gaps left by the adaptationist perspective, including the explanation of reproductive homologies and homoplasies, the developmental constraints associated with the evolution of reproductive modes, and the evolvability of reproductive characters. El estudio de las presas y embalses históricos es un campo desigualmente abordado desde la historiografía, la arqueología, la arquitectura o la ingeniería civil. En la península ibérica su estudio ha estado centrado en obras de grandes dimensiones que, en general son romanas, renacentistas o posteriores. Sin embargo, pocas veces se consideran las infraestructuras andalusíes, sus formas de implantación, cómo fue la transmisión del conocimiento de su tecnología o el ámbito social y cultural en el que se desarrollaron. Suelen ser (...) vestigios que se encuentran aislados y dispersos en el ámbito rural con el que dibujan un paisaje único. Esta circunstancia dificulta su documentación e impide el estudio a fondo de estas obras como condición, previa e imprescindible, para su conocimiento. La contribución de este trabajo es el resultado de una investigación realizada sobre el paisaje generado por uno de los pocos ejemplos de presa de contención conocidos en al-Andalus de los que aún se conservan restos. Se trata de una barrera fluvial levantada, a mediados del siglo XII, en la cuenca del río Trujala en el municipio de Segura de la Sierra (Jaén); un dique que transformó un campo en un pequeño mar o albuhera. In contrast to most Western countries, routine offer of prenatal screening is considered problematic in the Netherlands. The main argument against offering it to every pregnant woman is that women would be brought into a moral dilemma when deciding whether to use screening or not. This paper explores whether the active offer of a prenatal screening test indeed confronts women with a moral dilemma. A qualitative study was developed, based on a randomised controlled trial that aimed to assess the decision-making (...) process of women when confronted with a test offer. A sample of 59 women was interviewed about the different factors balanced in decision-making. Participants felt themselves caught between a need for knowledge and their unwillingness to take on responsibility. Conflict was reported between wishes, preferences and ethical views regarding parenthood; however, women did not seem to be caught in a choice between two or more ethical principles. Participants balanced the interests of the family against that of the fetus in line with their values and their personal circumstances. Therefore, we conclude that they are not so much faced with an ethical dilemma as conflicting interests. We propose that caregivers should provide the opportunity for the woman to discuss her wishes and doubts to facilitate her decision. This approach would help women to assess the meaning of testing within their parental duties towards their unborn child and their current offspring. (shrink)

El objetivo principal del presente trabajo de investigación es esclarecer el papel de la alteridad y el reconocimiento en Leibniz, tanto en su lógica de la alteridad y su teoría de la justicia universal, como en su fundamentación ontológica en la naturaleza expresiva y composible de los espíritus. Para lograr este objetivo, he dividido esta investigación en dos partes: en la primera parte busco mostrar en qué medida la alteridad y el reconocimiento son indispensables para comprender la filosofía práctica del (...) hannoveriano; mientras que en la segunda busca analizar la naturaleza expresiva y composible de los espíritus, a fin de articular una incipiente fundamentación ontológica de la moral leibniziana. Se revisan las noticias que la prensa nacional publicó durante la inauguración del Museo Nacional de Antropología en 1964, y se exploran otras noticias de naturaleza semejante, como la inauguración del Museo Nacional del Virreinato de Tepotzotlán y el Museo de Arte Moderno, al tiempo que se reflexiona sobre la identidad nacional, el patrimonio y el papel del museo en la sociedad y la cultura mexicana.

In “Datafeudalism: The Domination of Modern Societies by Big Tech Companies” (Saura García in Phil Technol 37(3):1–18, 2024a) I analysed the concept of datafeudalism and its implications for the proper functioning of democracy. In this article, I put forward the hypothesis that big digital companies are exercising domination over the current social context and its different functional spheres, such as politics and democracy, and critique the negative implications that datafeudalism is having for the proper functioning of modern democratic systems. (...) In this regard, Wörsdörfer (Phil Technol 37(3):1–5, 2024) has offered a critical commentary on the content in question. Toleration and neutrality are not always distinguished. When they are, they are often offered as two complementary solutions for the problem of achieving political unity and a degree of mutual acceptance within a pluralist liberal polity. The essay shows the concepts to be fundamentally distinct, and then argues that instead of being mutually supporting, they are mutually exclusive. Neutralist liberals, it is argued, must give up toleration in favour of the virtue of neutrality on the part of citizens.

The concept of information has been extensively studied and written about, yet no consensus on a unified definition of information has to date been reached. This paper seeks to establish the basis for a unified definition of information. We claim a biosemiotics perspective, based on Gregory Bateson’s definition of information, provides a footing on which to build because the frame this provides has applicability to both the sciences and humanities. A key issue in reaching a unified definition of information is (...) the fundamental problem of identifying how a human organism, in a self-referential process, develops from a state in which its knowledge of the human-organism-in-its-environment is almost non-existent to a state in which the human organism not only recognizes the existence of the environment but also sees itself as part of the human-organism-in-its-environment system. This allows a human organism not only to self-referentially engage with the environment and navigate through it, but also to transform it in its own image and likeness. In other words, the Fundamental Problem of the Science of Information concerns the phylogenetic development process, as well as the ontogenetic development process of Homo sapiens sapiens from a single cell to our current multicellular selves, all in a changing long-term and short-term environment, respectively.
